
A judge of the Superior Court of Marin County restored the criminal procedures for a woman from San Rafael accused of killing her mother last year.
Tonatzyn Oris Beltrán, 30, declared himself innocent for reasons of madness under his murder in September. On Thursday, Judge Geoffrey Howard reviewed a mental health report that he considered that Beltrán was competent to be tried. Established the next hearing for May 14.
The defendant underwent mental health evaluations after his defense lawyer declared doubts in his competence for the trial. Beltrán’s lawyer, Matthew Siroka, said his mental state decreased in jail and that he needs hospital treatment.
The defendant is accused of fatally stabbing Olivia Beltrán in the victim’s house on Way crest in January 2024. The officers saw her stand with a knife in her hand while her mother lay the next balcony, authorities reported. Police said the defendant transmitted the live incident on social networks.
Siroka said that now it is up to the Prosecutor to agree if Beltrán was legally crazy that the incident time changed. He said that the client is transferred to a state hospital instead of undergoing a trial.
“That is the result we expect, the community moves, the family sug and is appropriate giving their serious mental illness,” he said.
Prosecutor Roopa Krishna declined to comment after Thursday’s hearing.
